Achieving NIW Approval without English Publication

Jing Amy Feng

Dr. Lee is an experienced public health expert from Korea, who is responsible for managing public health populations around the world on behalf of his employer. He received his Ph.D. from a Korean University, and has since then been making monumental impacts to his field. While the field of public health encompasses a vast array of subject areas, Dr. Lee’s work primary involves ensuring the most efficient access to health care is available in the most economically depressed regions of the world. Accordingly, he works to appropriate the necessary health and medical resources that are required in those regions. When evaluating his chance to apply for the NIW application, Attorney Feng believed that his rich experience as researcher and social worker could support him for the EB-2 NIW category, however, his publications were all in Korean journals. Without English publications, it is challenging to persuade USCIS on what he has achieved and how his continued work in U.S. will benefit the country. The only chance for NIW approval is a well-planned strategy with sufficient evidence on his global impacts.

To prove his achievements and influences, we detailed his major projects. For example, he is at the forefront of most developing countries in helping them to ensure they have a robust public health plan to accommodate for their economic structure. His work is founded on the basis for long-term planning so that people’s environments are protected for generations to come. That being said, Dr. Lee’s work is more globally oriented rather than specific to the interest of the United States, so Attorney Feng accordingly tailored his petition so that the requirements for the NIW would be met. Having helped many international researchers apply for the NIW category, Attorney Feng knew exactly which points to emphasize to build a strong case for Dr. Lee.  Besides Dr. Lee’s own publications, Attorney Feng also included some of his peers’ independent evaluations, his dignitary awards, conference invitations, and memberships to prove that Dr. Lee’s work has had a significant influence in the U.S. By fully discussing the impacts of Dr. Lee’s past and continued work in the field, Attorney Feng successfully emphasized his research experience and contributions in his petition. In terms of his future contributions in U.S., Attorney Feng addressed how Dr. Lee’s experience could be critical to manage nature disasters in U.S. With stunning statistic info of few recent major nature disasters in U.S., it is so obvious that Dr. Lee is critically important to our nation.

It is in general a tough case, let along under today’s immigration environment. Dr. Lee’s case took around 12 months to be approved without any challenge. Without highly skilled attorney’s help, it is impossible to achieve success for tough cases today.

We encourage you to send us your CV to evaluate whether you have a good chance to succeed under EB1 or EB2 NIW categories.
