Starting Oct 1st, 2020, Date of Filing will be applied (Chart B)

Following our newsletter of “Be Prepared to file I-485 in Oct 2020” sent to you two days ago, USCIS announced today that starting Oct 1st, 2020, the Date of Filing Chart in Oct Visa Bulletin will be applied. It means that if your Priority Date is on or before the cut-off date showing in the following chart, you are eligible to submit I-485 in Oct 2020.

As Visa Bulletin is updated every month, the window of filing I-485 may not be open for long. We advise our clients that if you are eligible to submit I-485 in Oct 2020, please take advantage to submit your I-485 as soon as possible. With I-485 pending, you and your family members could legally stay and work even without valid non-immigrant visa.

Please be advised that SCIS fees will increase on October 2nd and a new, yet to be released, I-485 form will be required on that date, more importantly, public charge rule will be applied to I-485 filing as well. Please consult with an experienced lawyer for your I-485 filing.
